Whilst it cannot be denied that the municipal authorities of that town might have had some genuine cause for concern or could have taken reasonable action to eliminate the noise and visual pollution coming from the two blocks of flats which were a source of inconvenience to the non-Roma neighbourhood, the proposal to build a wall to separate and segregate the two communities was most disquieting since it amounted to an affront to human dignity and was a clear breach of the principle of equality of individuals before the law.
ولا يمكن أن يُنكر أن السلطات البلدية لهذه المدينة قامت بذلك ربما بسبب وجود مصدر حقيقي للقلق، أو أنه كان من الممكن لها أن تتخذ إجراءً معقولاً للقضاء على الضوضاء والمنظر البشع لهاتين العمارتين اللتين كانتا تشكلان مصدر إزعاج للأحياء المجاورة غير الغجرية، لكن اقتراح بناء حائط لفصل وعزل الطائفتين كان مقلقاً جداً لأنه كان يمثل إهانة لكرامة الإنسان وانتهاكاً واضحاً لمبدأ المساواة بين الناس أمام القانون.
