  4-6 وأخيرا، تفيد الدولة الطرف بأن المحاكم الوطنية تناولت ادعاءات صاحب البلاغ بدقة وبأن محاكم استئناف الدولة الطرف وليس اللجنة هي المختصة، وفقا لسوابق اللجنة(4) ، تقدير الوقائع والأدلة المطروحة في قضية معينة، ما لم يتبين أن المحاكم الوطنية منحازة بصورة واضحة.
