In this framework, a secured creditor may obtain a conditional right (“equitable title”) to take full title to the encumbered intellectual property right in case of default and enforcement, or the secured creditor may take the full title and leave the debtor with the conditional right (“equity of redemption”) to recover the full title upon satisfaction of the secured obligation.
وفي هذا الإطار، يجوز أن يحصل دائن مضمون على حق مشروط ("سند إنصافي") في الامتلاك الكامل لحق الملكية الفكرية المرهون في حال التقصير والإنفاذ، أو قد يأخذ الدائن المضمون سند الملكية الكامل ويترك للمدين الحق المشروط ("حق إعادة الشراء") في استرداد سند الملكية الكامل عند الوفاء بالالتزام المضمون.
