As regards evidence, four male witnesses of good character must testify against the accused that they witnessed his penis entering his partner's vagina, as the kohl-stick enters the kohl-jar, and if they do not so testify, their testimony is not enough to make the doctrinal punishment for adultery applicable. Moreover, if they differ in their testimony, their testimony is invalid.
أما البينة فهي أن يشهد على المتهم بفعل الزنا أربعة رجال عدول، يذكرون أنهم شاهدوا دخول ذكره في الفرج، كدخول المرود في المكحلة، فإن لم يشاهدوا ذلك على هذه الصفة لم تكن شهادةً موجبةً للحد في الزنا، وإذا اختلفوا في الشهادة بطلت شهادتهم.
As for discovery, this means that four good men must witness the accused committing adultery. They must see the man's penis enter the woman's vagina, like a kohl stick entering a kohl pot. If they have not seen this, then the testimony does not give rise to the hadd for adultery. If the witnesses disagree about what they saw, then their testimony is invalid.
١٨٢- أما البينة فهي أن يشهد على المتهم بفعل الزنا أربعة رجال عدول، يذكرون أنهم شاهدوا دخول ذكر الرجل في فرج المرأة، كدخول المرود في المكحلة، فإن لم يشاهدوا ذلك على هذه الصفة لم تكن شهادةً موجبةً للحد في الزنا، وإذا اختلفوا في الشهادة بطلت شهادتهم.
