According to the National Police, in the first nine months of 2005, only 20 per cent of arrests were preceded by a judicial warrant, while the remaining 80 per cent were based on flagrancy.
فقد أشارت الشرطة إلى أن نسبة عمليات التوقيف التي تمت بأمر قضائي لـم تتجاوز 20 في المائة في الأشهر التسعة الأولى من عام 2005، بينما تمت نسبة ال 80 في المائة المتبقية في حالة التلبس.

The Working Group stressed that making amparo proceedings effective was urgently needed to fight arbitrary detention and that the concept of equipollent flagrancy was incompatible with the principle of the presumption of innocence.

These courts, known as Flagrancy Courts, have had very positive effects, significantly shortening trials and reducing impunity for crimes committed against the person and property - crimes which are a serious source of concern in society.
وخلَّفت ما سمي "محاكم التلبس" آثاراً إيجابيةً جداً: إذ أتاحت تقليص فترة المحاكمة بقدر كبير والحد من إفلات المجرمين من العقاب على جرائم ارتكبوها ضد الأشخاص والممتلكات وهي الجرائم التي تشغل بال السكان كثيراً(40).

It was also reported that the Attorney-General's Office has subsequently endorsed initiatives on the part of the security forces in carrying out so-called “voluntary” searches and raids, arrests that did not satisfy the necessary requirements in order to be justified or legitimate, or the application of the notion of “permanent flagrancy”, a concept incompatible with international rules.
وذُكر أيضاً أن مكتب النائب العام أقر بعد ذلك مبادرات من جانب قوات الأمن بشأن القيام بما يسمَّى عمليات تفتيش وغارات "طوعية"، واعتقالات لا تستوفي الشروط الضرورية لكي تكون مبررة أو مشروعة، أو تطبيق مفهوم "الفظاعة الدائمة": وهو مفهوم يتنافى مع القواعد الدولية.
