“Any proximate cause analysis of a strict liability claim, to the extent applicable at all, should not include a component of foresight by a reasonable person in the shoes of the defendant … The essence of strict liability … is that a plaintiff need not prove that the defendant acted intentionally or negligently … If courts become bogged down in an analysis of the details of the use of the instrumentality, the analysis becomes one of negligence.
"ولا ينبغي أن يشمل أي تحليل لأقرب سبب ادعاء المسؤولية المشددة، إلى المدى الذي يمكن تطبيقها فيه على الإطلاق، عنصر الإدراك للعواقب من جانب شخص عاقل بضع نفسه موضع المدَّعى عليه فجوهر المسؤولية المشددة هو أن المدعي لا يلزمه أن يثبت أن المدَّعى عليه تصرف عمداً أو بإهمال فإذا شغلت المحكمة نفسها بتحليل تفاصيل استخدام الوسيلة، يصبح التحليل بمثابة تحليل للإهمال.
