As a rule, however, the grantor will not only collect fruits and revenues, it will dispose of them in the ordinary course of business free of the security right.
ولكن المانح، كقاعدة، لا يحصِّل الثمار والإيرادات فحسب، وإنما يتصرف فيها في سياق العمل المعتاد خالية من الحق الضماني.

As a rule, however, the grantor in possession will not only collect fruits and revenues, it will also dispose of the fruits in the ordinary course of business free of the security right (presumably generating proceeds that will become encumbered assets.
ولكن المانح الحائز، كقاعدة، لا يحصِّل الثمار والإيرادات فحسب، بل يتصرف أيضا في الثمار في سياق العمل المعتاد خالية من الحق الضماني (التي يفترض أنها تدر إيرادات ستصبح موجودات مرهونة).

« وقالوا » قومه « إن نتبع الهدى معك نتخطف من أرضنا » ننتزع منها بسرعة قال تعالى « أَو لمْ نمكن لهم حرما آمنا » يأمنون فيه من الإغارة والقتل الواقعين من بعض العرب على بعض « تجبى » بالفوقانية والتحتانية « إليه ثمرات كل شيء » من كل أوب « رزقا » لهم « من لدنا » عندنا « ولكن أكثرهم لا يعلمون » أن ما نقوله حق .

وقال كفار " مكة " : إن نتبع الحق الذي جئتنا به ، ونتبرأ من الأولياء والآلهة ، نُتَخَطَّفْ من أرضنا بالقتل والأسر ونهب الأموال ، أولم نجعلهم متمكنين في بلد آمن ، حرَّمنا على الناس سفك الدماء فيه ، يُجلب إليه ثمرات كل شيء رزقًا مِن لدنا ؟ ولكن أكثر هؤلاء المشركين لا يعلمون قَدْر هذه النعم عليهم ، فيشكروا مَن أنعم عليهم بها ويطيعوه .

These include, most importantly: (a) the obligation (invariably imposed upon the party in possession of the encumbered assets) to care for, maintain and preserve it; (b) the right to use, transform, mix and manufacture encumbered assets; (c) the right to collect fruits, revenues and proceeds generated by the assets and to appropriate these to one's use; and, in some States, (d) whether the secured creditor has the right to pledge, re-pledge or dispose of encumbered assets, whether free of, or subject to, the security right.
وأهم ما يتضمّنه ذلك هو: (أ) الالتزام (الذي يفرض دائما على الطرف الحائز للموجودات المرهونة)، ليعتني بها ويصونها ويحفظها؛ (ب) وحق استخدام الموجودات المرهونة وتحويلها وخلطها وصنعها؛ (ج) وحق تحصيل الثمار والإيرادات والعائدات التي تدرّها الموجودات وتخصيصها لاستخدامه الخاص وفي بعض الدول؛ (د) مدى تمتع الدائن المضمون بالحق في رهن الموجودات المرهونة أو إعادة رهنها أو التصرف فيها، سواء كانت خالية من الحق الضماني أو خاضعة له.

وأهم ما يتضمّنه ذلك هو (أ) الالتزام (يفرض دائما على الطرف الحائز للممتلكات المرهونة، ليعتني بها ويصونها ويتخذ الخطوات اللازمة لحفظ قيمتها)؛ (ب) حق استخدام الممتلكات المرهونة وتحويلها ومزجها وصنعها؛ (ج) حق تحصيل الثمار والإيرادات والعائدات التي تولدها الممتلكات وتخصيصها لاستخدامه الخاص؛ (د) حق رهن الموجودات المرهونة أو إعادة رهنها أو التصرف فيها، سواء كانت خالية من الحق الضماني أو خاضعة له.
