  وبرهنت أيضا المحكمة الأوروبية لحقوق الإنسان على إمكانية حماية حقوق المدعين الاقتصادية والاجتماعية في إطار الحقوق المدنية والسياسية(9)، شأنها في ذلك شأن اللجنة المعنية بحقوق الإنسان(10). غير أن من المهم التشديد على أن حماية الحقوق الاقتصادية والاجتماعية والثقافية من منظور الحقوق المدنية والسياسية هي حماية جزئية الطابع ولا تعدو أن تكون حلا مؤقتا في ظل غياب الاعتراف القانوني الفعلي بكافة حقوق الإنسان.
