• The Committee notes with appreciation the adoption of the third law to amend the federal law on child benefits (entered into force on 1 January 2001) which improves the possibility for both parents to take parental leave and the amendment of the law on parental custody which provides for shared parental custody (Sorgerecht) even when they are divorced, separated, or not married, but remains concerned that the judicial system is not yet prepared to fully implement this latter legislation.
  تحيط اللجنة علماً مع التقدير باعتماد القانون الثالث لتعديل القانون الاتحادي الخاص باستحقاقات الطفل (دخل حيز النفاذ في 1 كانون الثاني/يناير 2001) والذي يحسن إمكانية الاستفادة من إجازة الأبوة والأمومة المتاحة للوالدين، كما تحيط علماً مع التقدير بتعديل قانون حضانة الأطفال الذي ينص على تقاسم المسؤولية عن هذه الحضانة بين الوالدين (Sorgerecht) حتى عندما يكون الوالدان مطلقين أو منفصلين أو غير متزوجين، ولكنها تظل قلقة لأن النظام القضائي ليس مهيئاً حتى الآن لتنفيذ هذا التشريع الأخير تنفيذاً تاماً.
