It has been argued in this connection that habeas corpus has evolved in Costa Rica from a means of protecting the freedom of movement (restorative habeas corpus) to a guarantee of the principle of criminal defence, which now also functions as a means of preventing possible violations of liberty (preventive habeas corpus).
وقيل في هذا الصدد إن طلب المثول أمام المحكمة في كوستاريكا قد تطور مؤخراً وإنه أصبح وسيلة لضمان مبدأ الدفاع الجنائي بعد أن كان آلية لحماية حرية التنقل (طلب المثول أمام المحكمة للجبر)، بل وإنه أصبح يفيد اليوم في تفادي انتهاكات محتملة لحرية الأفراد (طلب المثول أمام المحكمة الوقائي).
