  وبذلـك لا يجوز لأي شخص - باستثناء السلطات القضائية أو الإدارية أو الصحية أو الطبية المرخص لها بموجب القانون - أن يجمّع أو يسجل أو يستخدم المعلومات الاسمية ذات الطابع الطبي، المتعلقة بالمخالفات أو الإدانات أو تدابير الأمن، أو أيضاً تلك التي تبين آراء أو انتماءات سياسية أو عرقية أو دينية أو فلسفية أو نقابية، إلا بعد قبول مكتوب وصريح من جانب الشخص المعني؛ ويجوز للشخص المعني، في أي وقت من الأوقات أن يسحب قبوله هذا وأن يطلب من الشخص الذي جهز المعلومات أو الشخص الذي يستعملها إتلاف المعلومات المتعلقة به أو محوها.
