Inheritance and testamentary arrangements are regulated by Act No. 25 of 1944, which stipulates that inheritance and testamentary law must be consistent with the law of the land.

“(a) the creation, execution or revocation of a will or testamentary instrument;

(i) a will, codicil or any other testamentary instrument to which the Succession Act, 1965, applies,

“(1) a law governing the creation and execution of wills, codicils, or testamentary trusts;

Their defiance of the authority of their natural or testamentary guardian;

“1. The creation, execution, variation, revocation, revival or rectification of a will, codicil or any other testamentary document.

More often men are resorting to testamentary disposition by way of will to deny women their legitimate share.

This right was granted as part of the mandatory testamentary provisions contained in article 369 of the Code.

15 In Fiji, persons with mental disabilities who fulfil the requirements as to testamentary capacity may write a valid will (Wills Act).

Upon the death of a husband, the widow may acquire property if the husband has bequeathed it to her by will or testamentary disposition.
