H. Stay of execution pending appeal or pardon

In three other cases, individuals sentenced to death were pardoned from execution by the family of the victim at the execution site.

Executions took place up until the day this report was completed and many people are awaiting execution or a presidential pardon.

It should be noted that at the time of the Independent Expert's field mission, 19 other persons were awaiting execution, and that presidential pardons were unlikely given the recent events.

“1. None of the provisions of the Rome Statute regarding the exercise of jurisdiction by the International Criminal Court preclude the concession of amnesties, or executive or judicial pardons by the Colombian State with regard to political crimes, provided such a concession is in accordance with the Constitution and with the principles and norms of international law as accepted by Colombia.”

In the case of capital punishment, after a final verdict has been issued, if the person condemned to execution requests a pardon, then, at the suggestion of the court charged with enforcement of the verdict or of the National Organization for Prisons and Corrective Action, and pending the latter's decision, enforcement of the verdict will be postponed.

Under the presidential system, the President of the Republic exercises the powers granted by article 58 of the Constitution: ensuring the country's security; supervision of the constitutional executive bodies; appointment of holders of constitutional and judicial posts; presiding over the Council of Ministers; declaration and termination of the state of war; representation of the State in its foreign relations; appointment of ambassadors; endorsing laws; in addition to endorsing execution sentences, granting pardons and seeking the opinion of the Constitutional Court.
