While the proclamation is the prima facie responsibility of the political authorities, which are best placed to assess the scale of the emergency, the repeated resort to unjustified emergency measures has prompted various high-level courts to question en passant the grounds for declaring states of emergency.

It may be noted that this question has come up en passant in the context of article 47.1 of the draft articles on responsibility of States for internationally wrongful acts (General Assembly resolution 56/83 of 12 December 2001, annex), dealing with the situation concerning the issue of plurality of responsible States.
