In regard to adequate housing, this Part provides for the quiet enjoyment of the demised premises, for the landlord's overriding obligation to keep the premises reasonably fit for human habitation during the tenancy, to keep in repair the structure and exterior of the premises, to keep in repair and in proper working order the installations in the premises for the supply of water and electricity, and to keep in good order and condition any part of the building or curtilage which the tenant is entitled to use (these parts must be well lit, safe to use, and be able to adequately perform their function).

Normally it is the owner that bears the risk of loss and, therefore, has the primary obligation to care for the asset, maintain it, keep it in good repair and insure it; and normally, it is the owner that has the right to further encumber the asset and to dispose of it.
