The perpetrator in the case of pederasty had been extradited and jailed and was currently under criminal prosecution.

6.3 She asserts that the invalidation of the evidence consisting of the video recording of the minor's statement is arbitrary and sanctions impunity for pederasty.

Chapter I, on offences against the normal development of sexual relations, covers rape (article 298), pederasty with violence (article 299) and lascivious abuse (articles 300 and 301). Law No. 87 of 1999 provides further penalties for the first two of these offences.

In addition, she would like to know whether information was available on the incidence of pederasty with both boys and girls, what punishments were applied to perpetrators and whether their punishments were different from those applied to persons who committed incest with children.

58 It is worth emphasizing here the issuing of Decree nº 4.229 of 13 May 2002, which reviewed the National Human Rights Plan and offered the following proposals for State action in the area of sexual orientation: an amendment to the Federal Constitution to guarantee the right to free sexual orientation and the prohibition of discrimination by reason of sexual orientation; the regulation of civil partnership between persons of the same sex and of the law re-designating sex and change of civil registry for transsexuals; improvement of the penal legislation with regard to discrimination and violence motivated by sexual orientation; exclusion of the term `pederasty' from the Military Penal Code; inclusion of data on sexual orientation in demographic censuses and official surveys.
