Parts Two and Three as adopted on first reading: general considerations

There was agreement on certain considerations. First, the innocent victim should not, in principle, be left to bear the loss.

He recalled his delegation's intervention from the January session in two similar cases, in which the Committee rejected in an — at that point — unprecedented way, two applications of organizations focusing on gay and lesbian issues on the first consideration.

This would imply that the first meeting on the consideration of a report should take place in the afternoon, and the second meeting the next morning.

Delegations should also ensure that statements on the first topic for consideration were ready as soon as that topic appeared on the agenda.

Given the commitment to ensure successful implementation of resolution 20/18, which requested UN-Habitat to continue the international dialogue on decentralization at World Urban Forum III and other relevant forums, the Executive Director convened a special meeting, in Vancouver, on 18 June 2006, focusing on: first, final consideration, in the form of a tour de table, of the current draft of the international guidelines on decentralization; second, discussion, in the form of a tour de table, of the format of the proposed compendium of best practices on decentralization and local democracy; and, third, exchange of views on the future role of the Advisory Group of Experts on Decentralization.

(d) Reports of the First Committee to the General Assembly at its sixty-first session on its consideration of the disarmament items on the agenda (A/61/386 to A/61/403), also containing lists of documents submitted in connection with those items.

This rule rests on two considerations, the first of which is respect for the sovereignty of the foreign State in whose territory the individual is living, his subjection to the national jurisdiction of that State and the assumption that such jurisdiction is unbiased and neutral.

The commentary on article 22 of the draft articles on State responsibility adopted by the Commission on first reading warns that consideration of the topic of exhaustion of local remedies “must at all costs stop short of the content of `primary' rules of international law.” This warning was, however, in the context of the codification of State responsibility and does not preclude the Commission from adopting a different approach in a study on diplomatic protection.
