Upon delivery of the goods to a carrier or performing party

As to the delivery of the goods “to a carrier for carriage”, a suggestion was made that additional language should be introduced to clarify that the consignor should deliver the goods to the “actual” or “performing” carrier.

No reference is made to delivery to a performing party or delivery by anyone acting on behalf of the shipper or consignee. The substantive provisions of the Draft Instrument refer to the consignor expressly only in Art. 8.1, where this party is given a right to demand a receipt upon delivery of goods to a carrier or performing party.
