The relevance of the difference between a fixed charge and a floating charge on an asset relates to the priority of the charge: a fixed charge generally represents a paramount charge on the asset, while a floating charge may be subject to certain preferential claims in favour of tax authorities and other third parties, or a carve-out in favour of unsecured creditors (see also para. 196 below).
