The cases that present difficulties are where the treaty provides no clear indication of the intentions of the parties, and where that intention must be presumed from the nature of the treaty or from the concomitant circumstances.
فالحالات التي تثير صعوبات هي الحالات التي لا ترد فيها في المعاهدة أي إشارة واضحة إلى نية الأطراف، ويتعين فيها افتراض تلك النية انطلاقا من طبيعة المعاهدة أو من الظروف الملابسة.
